Navigating the New Rules for Essential Non-NDIS Supports
Navigating the NDIS can sometimes feel overwhelming, especially with the new rules that came into effect on October 3rd, 2024. These changes include clearer definitions of what can and cannot be funded as an NDIS support.
While some items are now on the “out” list – meaning they’re generally not considered NDIS supports – there’s good news for participants who still see value in these excluded items.
The introduction of replacement supports provides a pathway to access certain excluded items under strict conditions. Let’s break it down.
What Are Replacement Supports?
Replacement supports allow participants to use their NDIS funding to purchase specific items from the “out” list, provided they meet several criteria. These include:
- Standard household items, such as washing machines or robot vacuum cleaners.
- Technology like smartwatches, tablets, and smartphones.
- Accessibility and communication apps.
The goal is to ensure these items can directly replace or reduce the need for other approved NDIS supports, creating a more cost-effective or outcome-driven solution.
What Criteria Must Be Met?
Applying for a replacement support involves demonstrating that the item:
- Will replace one or more approved supports in the participant’s plan;
- Is equal to or less expensive than the supports it replaces;
- Offers the same or improved outcomes compared to the replaced supports; and
- Complies with specific NDIS guidelines.
If the item is a standard household product, additional evidence is required to show that it addresses the participant’s impairment needs, increases independence, and reduces reliance on support workers or other assistive technologies.
For technology-based requests, such as a smartwatch or accessibility app, the participant must show that the item is necessary to meet communication or accessibility needs arising from their disability.
How to Apply for Replacement Supports
If you’re interested in accessing a replacement support, the process is relatively straightforward – you just have to:
- Confirm the item is eligible under the replacement support criteria.
- Contact the NDIS via their 1800 number to discuss the application over the phone, or complete the Application for a Replacement Support form and email it to [email protected].
Once approved, details about managing payments will be provided.
What If the Application Is Denied?
It’s important to note that decisions regarding replacement supports are not reviewable under section 99 of the NDIS Act. If your application is declined, you will need to wait 12 months before reapplying for the same item.
